These Terms of Use (“Terms”) apply to your use of MERIDIA, a mobile language learning application provided by Wekthor, s.r.o. (“we”, “us”, or “our”).
By downloading, accessing, subscribing to, or using MERIDIA, you agree to these Terms. If you do not agree, do not use the app.
MERIDIA means the mobile application listed on the Apple App Store as Meridia: 3D Language Learning.
1. App Store Terms
MERIDIA is distributed through the Apple App Store. Your download and use of the app may also be governed by Apple’s terms, including Apple’s App Store terms and Apple’s standard end user license agreement.
If there is a conflict between these Terms and Apple’s mandatory terms, Apple’s mandatory terms apply where required.
2. What the App Provides
MERIDIA is a language learning app. Some content may be available for free. Additional learning areas, lessons, features, or content may require an active paid subscription.
The app is provided for general educational and entertainment purposes. We do not guarantee that the app will make you fluent in any language or that all translations, explanations, pronunciations, examples, or learning content will be error-free.
3. Subscriptions
MERIDIA may offer auto-renewable subscriptions, including monthly and yearly subscriptions.
A subscription gives you personal, limited, non-transferable access to the paid content and features included in your subscription tier while your subscription is active.
Subscriptions are billed through your Apple account. The price, billing period, renewal terms, trial terms, and available subscription options are shown before purchase inside the app and/or in Apple’s purchase confirmation screen.
Subscriptions renew automatically unless canceled according to Apple’s subscription rules. You can manage or cancel your subscription through your Apple account settings.
We do not directly process your payment card details. Payments, renewals, cancellations, and refunds are handled by Apple according to Apple’s rules and applicable law.
4. Restore Purchases
If you reinstall the app, change device, or lose access to paid content, you should use the “Restore Purchases” option in the app.
Subscription access is connected to the Apple account used for the purchase. You are responsible for using the correct Apple account and keeping access to your device and Apple account.
We will make reasonable efforts to restore valid purchases, but we are not responsible for loss of access caused by your loss of access to your Apple account, device, iCloud, App Store account, or other services outside our control.
5. Access Is Not Ownership
Buying or subscribing to MERIDIA does not give you ownership of the app, source code, content, designs, text, translations, audio, graphics, characters, lessons, databases, or other materials.
You receive only a limited right to use the app and its content for your own personal, non-commercial use, subject to these Terms.
You may not copy, resell, redistribute, sublicense, reverse engineer, modify, scrape, extract, or commercially exploit the app or its content, except where applicable law expressly allows it.
6. Account, Device, and User Data
The app may use local device storage, Apple services, iCloud Keychain, backend services, purchase validation services, analytics, or similar systems to provide the app, remember progress, restore access, prevent fraud, improve the app, and provide support.
Progress backup, purchase restoration, and app data recovery may not always work perfectly. You are responsible for maintaining access to your device, Apple account, and relevant Apple services.
We do not guarantee that progress, settings, learning history, or locally stored data can always be restored.
7. Availability and Changes
We try to keep MERIDIA available and working, but we do not guarantee uninterrupted, error-free, or permanent availability.
We may update, change, suspend, remove, or discontinue parts of the app, content, features, languages, lessons, areas, backend systems, or services where reasonably necessary, including for maintenance, security, technical, legal, business, or operational reasons.
If we discontinue the app or a paid service, your statutory consumer rights and any refund rights available through Apple are not limited by these Terms.
8. Bugs, Errors, and Learning Content
The app may contain bugs, mistakes, incomplete content, mistranslations, pronunciation issues, technical issues, or compatibility issues.
You agree that the app is not a professional translation service, exam preparation guarantee, school, accredited course, or official language certification product.
You should not rely on the app as your only source for important, professional, legal, medical, financial, immigration, academic, or safety-related language decisions.
9. User Conduct
You agree not to misuse the app, bypass payment or subscription controls, interfere with servers or security systems, use the app unlawfully, copy or redistribute app content, or attempt to access non-public systems.
We may suspend or restrict access if we reasonably believe you violated these Terms, abused the app, attempted fraud, or created legal, security, or operational risk.
10. Privacy
Your use of the app is also governed by our Privacy Policy: Privacy Policy.
11. Third-Party Services
The app may depend on third-party services such as Apple, App Store, iCloud, analytics providers, crash reporting tools, hosting providers, payment validation systems, or other technical providers.
We are not responsible for third-party services, outages, account issues, data loss, policy changes, or errors outside our reasonable control.
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, MERIDIA is provided “as is” and “as available.”
We do not guarantee that the app will be uninterrupted, secure, error-free, accurate, complete, compatible with every device, available forever, or suitable for your specific needs.
Some jurisdictions do not allow certain warranty exclusions, so some parts of this section may not apply to you.
13. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of progress, loss of device access, loss of profits, loss of business, loss of goodwill, or service interruption.
To the maximum extent permitted by applicable law, our total liability for claims relating to the app or these Terms is limited to the amount you paid for the app or subscription during the 12 months before the claim.
Nothing in these Terms limits liability that cannot legally be limited, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence where applicable, or mandatory consumer rights.
14. Security and Data Breaches
We use reasonable technical and organizational measures to protect data. However, no app, server, device, network, or storage system can be guaranteed to be completely secure.
If a security incident occurs, we will handle it according to applicable law.
15. Termination
You may stop using the app at any time. You may cancel subscriptions through your Apple account settings.
We may suspend or terminate your access to the app if you breach these Terms, misuse the app, attempt fraud, create security risk, or if we are required to do so by law or by Apple.
Termination does not automatically cancel an active Apple subscription. You must cancel subscriptions through your Apple account settings.
16. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as updating this page or providing notice in the app.
Your continued use of the app after the updated Terms become effective means you accept the updated Terms.
17. Governing Law
These Terms are governed by the laws of Czech republic, except where mandatory consumer protection laws of your country of residence apply.
